Act CVIII of 2001, as amended in several cases, clearly states that all electronic advertisements sent to natural persons may be sent under the so-called opt-in system, i.e. with the prior consent of the recipient. Please note that so-called "opt-in" e-mails sent to individuals are also considered unsolicited mail. In the case of e-mails sent to company e-mail addresses (e.g. info@cegnev.hu), an opt-out system applies: the message is only considered to be unlawful if the addressee company has already asked the advertiser not to send an advertising mail to the address. The law also provides that in the event of a complaint, the Office of the National Communications Authority is the competent body to initiate a supervisory procedure for unsolicited electronic advertising. In addition, the General Inspectorate for Consumer Protection may also initiate an advertising supervision procedure, i.e. a procedure concerning the content of the advertisement. The Office of the National Communications Authority may prohibit the continuation of the offending conduct or impose an e-commerce fine (the General Inspectorate for Consumer Protection may also impose an additional fine on the offender)
In the case of improper and unlawful use of the newsletter service, our company, as an intermediary service provider, is entitled under national regulations to terminate the infringing activity by restricting the service, and such conduct may result in the immediate termination of the contract.
